Terms of Service
Please read these Terms of Service carefully before using the EVRCAD Insurance Suite.
01Acceptance of Terms
By accessing or using the EVRCAD Insurance Suite ("Service") operated by Evrcad LLC ("Company," "we," "us"), you ("User," "you") agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including agency administrators ("Managers") and field representatives ("Agents").
02Description of Service
EVRCAD Insurance Suite is a cloud-based, multi-tenant agency management platform designed for Medicare insurance agencies. The Service provides tools including: agent performance tracking, client relationship management, CMS-compliant Scope of Appointment (SOA) form generation, geo-verified time tracking, analytics dashboards, team management, and scheduling. The Service is a management tool only. It does not provide insurance advice, underwriting, claims processing, or act as a licensed insurance entity.
03Eligibility and Account Registration
To use the Service, you must: be at least 18 years of age; if acting as an insurance agent, hold a valid and active insurance license in your applicable state(s); provide accurate registration information; and maintain the security of your account credentials. Agency administrators are responsible for ensuring all invited Agents meet licensing requirements.
04Subscription and Payment
Access requires a paid subscription processed through Stripe. You agree to pay all applicable fees, authorize recurring billing unless canceled, and accept that fees are non-refundable except where required by law. We may change pricing with 30 days' notice.
05Acceptable Use
You agree to use the Service lawfully and in compliance with CMS Medicare Communications and Marketing Guidelines (MCMG), HIPAA, TCPA, and state insurance regulations. You agree NOT to: use the Service for unlawful purposes; upload malicious code; access other users' accounts; reverse-engineer the Service; resell access without written consent; or violate CMS marketing rules.
06CMS and Regulatory Compliance
The Service provides compliance tools including digital SOA forms. However, you are solely responsible for ensuring regulatory compliance. The Service does not guarantee compliance and is not a substitute for professional compliance guidance.
07AI-Powered Features
AI features provide suggestions only and require human review and approval. You are responsible for all communications sent, regardless of AI assistance. AI features will never autonomously enroll clients or make binding decisions. We do not guarantee accuracy or regulatory compliance of AI-generated content.
08Data Ownership and Portability
You retain ownership of data you input. We retain ownership of the Service, software, and aggregated/anonymized analytics. Upon request, we will export your data within 30 days of account termination. Your data is logically isolated from other organizations.
09Privacy
Your use is governed by our Privacy Policy.
10Intellectual Property
All rights in the Service are owned by Evrcad LLC. These Terms grant a limited, non-exclusive, non-transferable license during your active subscription.
11Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant uninterrupted or error-free operation.
12Limitation of Liability
Evrcad LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the amount paid in the 12 months preceding the claim.
13Indemnification
You agree to indemnify Evrcad LLC from claims arising from your use of the Service, violation of Terms, violation of law, or third-party claims including CMS compliance violations.
14Termination
We may suspend or terminate access at any time. Upon termination, you may request data export within 30 days. You may cancel anytime via account settings or support@evrcad.com.
15Dispute Resolution
Disputes shall be resolved through binding arbitration via the American Arbitration Association in Utah County, Utah. Class action waiver applies. Claims under $10,000 may be conducted online.
16Modifications
We may update Terms with notice via the Service. Continued use constitutes acceptance.
17General Provisions
Governed by Utah law. If any provision is unenforceable, the rest remain. These Terms plus the Privacy Policy are the entire agreement. Failure to enforce a right is not a waiver. You may not assign rights; we may.
